Definitions
In these General Terms and Conditions of Sale, the following terms shall apply:
Gift Voucher: means the document containing the offer, the place, the validity number, the date of validity and the description allowing to benefit from an offer within our establishment. The Gift Voucher may be issued by post and by digital means.
Gift box: refers to packaging in the context of a postal shipment.
A Gift Voucher or Voucher consists of the following:
– A Gift Voucher with the description of the service offered (and available on the Website http://hotelmunsch.com ).
– An envelope in which the Gift Voucher is packaged.
In the digital version, only an email will print the Gift Voucher.
The Gift Boxes thus defined are available in various thematic areas such as “Gastronomy”, “Stay”, etc…
Hotel Munsch Sarl reserves the right to complete the list of Gift Boxes available for sale or to stop their distribution at its sole discretion and at any time.
II-/ Terms and Conditions of Sale
You are offered online Gift Vouchers to order with payment obligation.
We invite you to read carefully the present General Conditions of Sale which define the terms and conditions in which Hotel Munsch Sarl sells its Gift Vouchers.
These Terms and Conditions of Sale are therefore only applicable for Gift Voucher orders placed on the Site www.hotelmunsch.com , directly by phone:+33 (0)3 89 49 81 61 or upon receipt of the establishment.
These conditions apply to the exclusion of all other conditions, including those in force for in-store sales.
These General Conditions of Sale are valid from 1 January 2015. They cancel and replace as of this date, all previous versions of these terms and conditions and prevail over all other Customer Terms and Conditions.
Hotel Munsch Sarl reserves the right to modify these Terms and Conditions at any time, without notice, on the understanding that such modifications will not be applicable to orders previously accepted and confirmed by Hotel Munsch .
Any Customer declares that it has the legal capacity in accordance with Article 1124 of the Civil Code to contract and use the Site in accordance with the General Conditions of Sale and Use of the Site.
ARTICLE 1: ORDER PROCESS WITH PAYMENT OBLIGATION AND CONTRACT FORMATION

ARTICLE 2: TERMS OF USE OF GIFT VOUCHERS AND RESPONSIBILITY
2.1: In the event that you are not the beneficiary of the Gift Voucher, you are invited to inform the beneficiary of the conditions set out below.
2.2: For the Gift Voucher to be valid, it must be validated. To do this, you must contact Hotel Munsch Sarl .

2.3: Only the presentation of the original of the Gift Voucher received by post or printed from the email entitles to a service.
2.4: The Gift Voucher entitles you to Services developed by, as indicated on the Site, either through an online reservation or directly with the establishment.
2.5: The Gift Box is valid according to the dates and days of the week specified on the Gift Voucher.
2.6: The photographs presented in the Gift Box are not contractual. Partial or complete reproduction is prohibited.
2.7: Except online booking, the delivery of the service will take place after the check by the establishment of the validity of the Gift Voucher and the payment in full of it. This control involves the validation of the Gift Voucher number by the institution to verify the actual activation of the Gift Voucher.
ARTICLE 3: PRICE AND TERMS OF REGULATION
Article 3.1: Prices
The prices of the gift boxes, displayed on the Site, are those in effect on the day of the order and they have TTC.

ARTICLE 4: RIGHT OF WITHDRAWAL
When purchasing a Gift Voucher, according to the terms of Article L.121-21 of the French Consumer Code, you have a period of 14 clear days (from the date of receipt of the product) to exercise your right of withdrawal without having to prove reasons or pay penalties, with the exception of return fees.
A simple cancellation email (boooking@hotelmunsch.com) is sufficient to cancel your Gift Voucher.
The return fee will remain at your expense. Only boxes and Gift Vouchers returned on time and in perfect condition (Gift Boxes returned without the presence of the Gift Voucher, damaged, soiled, will not be taken back) may be refunded.

Any return made in accordance with the conditions of this article will result in a refund of the full amount paid (except for express delivery charges) no later than fourteen days from the receipt of the Gift Box in perfect condition, by cheque or bank transfer, which you declare to accept without reservation.
ARTICLE 5: PROOF OF ORDERS/ARCHIVING
You are expressly informed that, unless you have made a manifest error, the data stored in the databases of Hotel Munsch Sarl have probative force as regards the orders placed.
Data stored on computer or electronic media on a regular basis shall constitute admissible and enforceable evidence in the same terms and with the same probative force as any document that is received and retained in writing.
ARTICLE 6: DELIVERY
Article 6.1: Availability of Gift Vouchers
The Gift Vouchers of the Hotel Munsch Sarl are published in limited quantity, on the one hand because of the limited capacity of reception and on the other hand because of the limited period of validity in the time of the Gift Vouchers.
In the event of a temporary or permanent stock shortage, the Customer will be informed of this unavailability because the order will not be successful.
In case of availability of products, the Hotel Munsch Sarl undertakes to honor any Gift Voucher order from the Customer.
In the event that the Distributor of the Gift Voucher is not the Service Provider of the offer included in the Gift Box and if an order cannot be honoured due to a stock shortage, you have the possibility to cancel your order. You will then be refunded the entire amount paid, within 30 days at the latest.
Article 6.2: Place of delivery
The Hotel Munsch Sarl ships the Gift Boxes or Gift Vouchers only in EUROPE.
The Gift Boxes or Gift Vouchers will be delivered to you at the address indicated when entering your order. The responsibility of L’Hotel Munsch Sarl cannot therefore in any case be incurred in any way in the event of your absence at the time of delivery or in the event of an entry error, when placing the order. The Customer must send any written request to the following address:br/>Hotel Munsch Sarl . br/>3 Rue du General, 67110 Niederbronn Les Bainsbr/>Upon the creation of its customer account on the Site, the Client will have the option to choose whether to receive offers from the Establishment and its partners.br/>strong>ARTICLE 10: FORTUITOUS CASE – FORCE MAJEURE/strong>br/>The performance by the Institution of its obligations under these General Terms and Conditions of Sale shall be suspended in the event of the occurrence of a fortuitous event or force majeure that would interfere with or delay execution.br/>The Institution shall notify the Client of the occurrence of such a fortuitous or force majeure case within 15 days from the date of occurrence of the event.br/>When suspension of the performance of the obligations of theEstablishment continues for a period exceeding 60 days, the Customer has the option of terminating the Order in progress and the Establishment will then proceed with the reimbursement of the Order under the conditions referred to in Article 6.br/>strong>ARTICLE 15: APPLICABLE LAW/strong>br/>The law governing these General Conditions of Sale and the contract concluded on the occasion of a Gift Box or Gift Certificate order, is the French law for all disputes relating, in particular, to their validity, their interpretation, performance or termination.br/>strong>ARTICLE 16: JURISDICTION (SETTLEMENT OF DISPUTES)/strong>br/>The court having jurisdiction in the event of a dispute shall be the Commercial Court of Paris in the case of a dispute between traders and assimilated persons (companies, branches, etc.) or that of the defendant’s place of residence or, at the choice of the applicant, from the place of actual delivery of the Gift Box in other cases.br/>em>Hotel Munsch Sarl . /em>br/>em> 16, route du Vin, 68590 Saint-Hippolyte/em>
